Regular Meeting – March 11, 2009

Chairman Gordon Ceskowske called the Regular Meeting of the Fox Lake
Inland Lake Protection and Rehabilitation District Board of
Commissioners to order on March 11, 2009 at the District Town Hall
office.

Role call – Present; Gordon Ceskowske, Kurt Heckl, Dennis VanderWerff,
Cheryl Witkowski, and Lionel Wagner. Also present: Les Schraufnagel,
operator; Kathleen Rydquist, clerk-coordinator; and Attorney William
O’Connor by telephone.

Motion by K. Heckl to move into closed session according to SS 19.85
(1) (g) conferring with legal counsel for the governmental body who is
rendering oral or written advice concerning strategy to be adopted by
the body with respect to litigation in which it is or is likely to
become involved. Second, L. Wagner. All yes. Motion carried.

Motion to close executive session and resume regular meeting K. Heckl,
second L. Wagner. All yes. Motion carried.

Motion to approve the minutes as printed, D. VanderWerff, second L.
Wagner. All yes. Motion carried.

Motion to approve the financial statement, subject to audit, by L.
Wagner, second K. Heckl. All yes. Motion carried.

Operators report:  attached
	
WCC report:
	The District and Commission will be reviewing an amendment to the MSA
Facility Plan. The amendment backs out almost all of the upgrades and
promotes only the new seepage cell project. The City, District, and
Commission will be having a special joint meeting later in March.

Clerk-Coordinator report:
	1]	Wisconsin Lake and Ponds have sent a mailing to local residents
urging them to sign up for herbicide treatment. Because of the amount
of runoff and forecasted spring rain, a letter was sent to Susan
Graham, DNR,  requesting the a moratorium be imposed on Fox Lake to
prohibit any herbicide treatment or harvesting until a point in the
future when it would again be advisable.
	2]	We received an email from Doris Thiele, DNR, regarding a Permittee
Workshop that will address, among other things, land-spreading of
manure, treatment plant waste, and industrial waste. The workshop will
take place on April 15th at Juneau. Anyone who would like to attend
should let the clerk know.
	3]	The Wisconsin Association of Lakes is holding a “Listening
Session” on Saturday, April 18th from 8:00am to noon at UW Green Bay.
The speakers will be Steve Hogler, Fisheries Biologist, speaking about
Invasive species in our area, Karen von Huene, WAL’s new Executive
Director, and Earl Cook, President of WAL Board of Directors.

	4]	The Rain Garden Workshop plans are coming together. The District
and the Lake Sinissippi District along with the UWEX are sponsoring
the free workshops. We will be paying for flyers, refreshments, and
advertising. The Fox Lake dates are April 21st from 6:30 to 8:30pm at
the Fox Lake Town Hall for Session I, and Saturday, May 9th from
9:00am at the same location. A plant sale will follow from 11:00am to
noon. The District will be meeting with people from the Rock River
Storm Water group to see if they would like to participate in some way
with the workshops.
	5]	The Newsletter is being written and articles about the well
testing, moratorium, and rain garden workshop will be included.

County report:
	A local farm (Drews) has again been brought to the attention of the
Land Conservation Department because of the serious pollution problems
that at evident.  The clerk is to call Hey & Associates to see if the
monitoring report (unfinished) has been or will be sent to LCD giving
them the ammunition they need to get this problem cleaned up.

Town report:
	Nothing much happening.

Old business:
	1]	Discussion and action regarding allocation of plant expansion
costs and changes to Service contract/Ordinance at Wastewater - The
District has discussed the cost allocations at wastewater with
Attorney O’Connor who is in negotiation with the City’s Attorney,
Jordan Hamaiden. Tabled to the next meeting.
	2]	Discussion and action regarding changing District policy for
collection of up-front money on properties with multiple DUE’s if they
plan to change their use. Tabled.
	3]	Discussion of carp barrier. Tabled.
	4]	Discussion and action to put out bids for pump replacement – Have
Ayers put together bids.

New business:
	1]	DNR Permittee Workshop – Anyone wishing to attend will contact the
clerk.
	2]	Letter to DNR to satisfy Stipulation – Motion by L. Wagner, second
K. Heckl to submit the cover letter and report to Doris Thiele, DNR to
satisfy the Stipulation. All yes. Motion carried. The letter will be
copied to the AAG Shari Eggleson, Attorney O’Connor, and the
Wastewater Control Commission. The clerk is instructed Barb Fisher at
Wastewater to have copies for each of the WCC commissioners.
	3]	Discussion on Management Strategy for Fox Lake 2009 – tabled.

Motion to pay the bills K. Heckl, second  D. VanderWerff. All yes.
Motion carried.

The next meeting will be April 8, at 9:00. TIME CHANGED TO 8:30.
