Town of Fox Lake Plan Commission Meeting Monday, August 3, 2009 at 7:00 p.m. Chairperson Turgeon called the meeting of the Town of Fox Lake Plan Commission to order at 7:00 p.m. Plan Commission members present were Roland Gallenberg, Dona Turgeon, Dennis Vanderwerff, Dean Streich, Denise Wingers, Joan Siewert and Thomas Wissing. Dennis Vanderwerff made a motion seconded by Denise Wingers to approve the agenda as printed. All in favor motion carried. Roland Gallenberg made a motion seconded by Dean Streich to approve the minutes of the July 6, 2009 meeting. All in favor motion carried. Chairperson Turgeon opened the public hearing. The first item addressed rezoning of a lot at N10620 Chief Kuno Trail, parcel number 018-1313-2332-016. Robert & Judith Barr of N10626 Chief Kuno Trail inquired what R-3 zoning meant and if more rental units would be built. John DeVries from MSA representing the buyer stated that R-3 allowed 3 to 7 residential units, not rentals. John Perez of N10632 Chief Kuno Trail also inquired about the number of units. Art & Carol Schmocker of N10633 Chief Kuno Trail and the others inquired as to what plans were for this lot. Mr. DeVries responded that no construction plans have been started but the R-3 Multi-Family zoning would permit flexibility. Steve Westphal the owner of the lot stated that the sale was not contingent on the rezoning. The second public hearing item addressed a variance for an accessory structure which might extend into the front yard at N10331 Howard Drive, parcel number 018-1313-2723-006. Fran Baierl appeared and presented a plot plan showing the location of the proposed structure on the property in relation to the existing home which indicated that the new structure would not extend beyond the home. Gary Ballweg appeared in support of this request. Chairperson Turgeon closed the public hearing. Denise Wingers made a motion seconded by Dean Streich to recommend to the Town Board to rezone the new lot 2 of parcel number 018-1313-2332-016 at N10620 Chief Kuno Trail from R-1 to R-3. All in favor motion carried. Thomas Wissing made a motion seconded by Joan Siewert to recommend to the Town Board to permit the construction of an accessory structure which would meet all side yard setback requirements on parcel number 018-1313-2723-006 at N10331 Howard Drive. All in favor motion carried. It appears that the Town may have to revise its zoning code to allow farmer to participate in the new Farmland Preservation Program. This will be addressed at the next meeting. The next meeting of Plan Commission will be November 2, 2009 at 7:00 p.m. Tom Wissing made a motion seconded by Dean Streich to adjourn.
