Town of Fox Lake Plan Commission Meeting Monday, November 2, 2009 at 7:00 p.m. Designated chairperson Dennis Vanderwerff called the meeting of the Town of Fox Lake Plan Commission to order at 7:00 p.m. Plan Commission members present were Roland Gallenberg, Dean Streich, Denise Wingers, Joan Siewert and Thomas Wissing, absent was Dona Turgeon. Thomas Wissing made a motion seconded by Dean Streich to approve the agenda as printed. All in favor motion carried. Roland Gallenberg made a motion seconded by Thomas Wissing to approve the minutes of the August 3, 2009 meeting. All in favor motion carried. Clerk Benter presented language changes for the accessory structures clause in the Town of Fox Lake Zoning Code. Dean Streich made a motion seconded by Joan Siewert to recommend to the Town Board to include the following the following language: Accessory Uses and Detached Accessory Structures In platted subdivisions or on lots less than two acres in area they are permitted in the rear and side yards of all lots; on waterfront lots and lots not in platted subdivisions they may be located in the front setback. Detached accessory structures shall not be closer to the lot line than the minimum required side yard for the principal structure and in any case they shall not be closer than 10 feet to the principal structure, shall not exceed 20 feet in height, and shall not be closer than three (3) feet to any lot line with a maximum roof overhang of two (2) feet. All in favor motion carried. Information currently indicates that in order for landowners to collect a tax credit under the new working lands initiative the land must be in a Farmland Preservation Zoning District. Denise Wingers made a motion seconded by Dean Streich to recommend to the Town Board to consider establishing Farmland Preservation Zoning in those areas currently zoned A-1 Prime Agriculture including developing appropriate language. All in favor motion carried. Proposed Land Division regulations to be adopted as a new Town of Fox Lake ordinance were reviewed. The Plan Commission will study the regulations and consider action at the next meeting. Thomas Wissing made a motion seconded by Joan Siewert to recommend to the Town Board to inform the Department of Corrections by letter that a conditional use permit must be applied for and certain requirements and procedures must be followed per the Town of Fox Lake Zoning Code in order to issue a conditional use permit for a dairy farm operated as a Confined Animal Facility. All in favor motion carried. The next meeting of Plan Commission will be January 4, 2010 at 7:00 p.m. Tom Wissing made a motion seconded by Denise Wingers to adjourn.
