Town of Fox Lake Plan Commission Meeting Monday, January 4, 2010 at 7:00 p.m. Designated chairperson Dennis Vanderwerff called the meeting of the Town of Fox Lake Plan Commission to order at 7:00 p.m. Plan Commission members present were Roland Gallenberg, Dean Streich, Denise Wingers, Joan Siewert and Thomas Wissing, absent was Dona Turgeon. Dean Streich asked to add Cypert driveway on County Road F to the agenda. Roland Gallenberg made a motion seconded by Thomas Wissing to approve the agenda as printed with the addition. All in favor motion carried. Thomas Wissing made a motion seconded by Denise Wingers to approve the minutes of the November 2, 2009 meeting. All in favor motion carried. Additional information regarding a Farmland Preservation Zoning District was reviewed including that after March, 2010 there will be only 5 farmers participating in the current farmland preservation program. Also, if land in the a district zoned as farmland preservation is rezoned, there may be a fine up to $1,000.00 per acre regardless if the owner is participating in the farmland preservation program. Joan Siewert made a motion seconded by Thomas Wissing to delay indefinitely any action on establishing a Farmland Preservation Zoning District. All in favor motion carried. Thomas Wissing made a motion seconded by Roland Gallenberg that the proposed Land Division regulations be referred to the Town Board for review before any action by the plan commission. All in favor motion carried. Clerk Benter presented the letter sent to the Department of Corrections that informed the Secretary that a conditional use permit must be applied for and certain requirements and procedures must be followed per the Town of Fox Lake Zoning Code in order to issue a conditional use permit for a dairy farm operated as a Confined Animal Facility. The plan commission will research various sources and develop a list of possible specific requirements if/when the Department of Corrections applies for a conditional use permit to establish a large dairy farm in the Town of Fox Lake. These suggestions will be reviewed at the next meeting. Dean Streich presented a letter received from Attorney Hoeper requesting assistance for Jerry Cypert in locating a driveway at his residence on County Road F. Since the Town has no jurisdiction on a county highway he inquired of the Dodge County Highway Commission how to proceed and was informed that a highway supervisor must review the request and if it was denied by the supervisor an appeal could be made to the Dodge County Highway Commission. The next meeting of the Plan Commission will be January 25, 2010 at 7:00 p.m. The Plan Commission will meet the 4th Monday of each month unless notified by the clerk that there is no need for a meeting.
