April 14, 2008 Monthly Board Meeting
Town of Fox Lake Monthly Board Meeting Monday, April 14, 2008 at 7:30 p.m. Chairman Wagner called the Town Board meeting to order with all officers present and 9 other citizens. The next monthly meeting will be May 12, 2008 at 7:30 p.m. The Fox Lake Fire Association will meet Tuesday, May 13, 2008 at 8:00 p.m. Supervisor Babros made a motion seconded by Supervisor Wissing to accept the minutes of the Town Board Meeting of March 10, 2008. All in favor motion carried. The Treasurer’s report as of March 31, 2008 showed receipts for Match, 2008 of $38,947.74, and disbursements of $66,354.83, with a balance in the regular checking account of $52,666.38. The LGIPF account had interest receipts for March, 2008 of $502.02 with a balance of $190,467.58. The Tax Savings Account had interest receipts of $807.63 with a balance of $306,833.70. The Municipal Court Savings Account had interest receipts of $2.84 fines and assessments deposited of $699.20 with a balance of $3,088.97. Supervisor Streich made a motion, seconded by Supervisor Lehman to accept the Treasurer’s report. All in favor motion carried. Armond Alsteen questioned if the Town Board had any power in determining telephone service in the Town. The Public Service Commission determines phone service. Officer Gebhardt provided the Board with the Police report. In March, 2008 the police officers worked 51 hours, responded to 1 complaint, assisted others 2 times, issued 2 warnings and 2 citations. Officer Gebhardt informed the Board that the new radio for the police vehicle should be installed in approximately two weeks. Supervisor Streich reported on actions taken at the Randolph Fire Association meeting. The Randolph Fire Department is requesting a new vehicle for hauling personnel and equipment. Representatives at the meeting suggested they seek a used vehicle to be included in the 2009 budget at a cost not to exceed $60,000. The secretary-treasurer of the Association was removed from that office by a decision of only three representatives of the Association and a new person was appointed. Supervisor Streich felt that this was an inappropriate action and did not follow the contract and that if decisions are to be made in this manner perhaps the Town of Fox Lake should consider withdrawing from the Randolph Fire Association. Supervisor Lehman spoke against withdrawal and there was no support for withdrawal from other supervisors. No action was taken. Supervisor Babros suggested that the Roads Committee investigate the cost of placing yellow reflective striping on the sides of stop sign poles. Supervisor Streich will investigate the cost. Ted Kahlow made a comment from the audience that perhaps street lighting should be considered at certain intersections. There was no support for street lighting by Town board members. For Parks & Lakes, a discussion about moving the piers across the parking lots resulted in the possibility of using a flat bed truck with a winch. The Town will not participate in the weed treatment around the handicapped pier at Fox Lake as offered by the Inland District. Armond Alsteen wondered if there were actually some helixors in the Fox Lake aeration system which were broken off. Supervisor Wissing stated there were but that the forced air was still opening holes in the ice. Frank Moore appeared and asked the Town Board to consider a Minor Land Division involving parcel numbers 018-1313-1611-001 and 018-1313-1612-000. This property is located in section 16 of the Town of Fox Lake. The Moore’s plan is to create a separate parcel at this site of approximately 6 acres which would separate the parcel with the buildings from the existing parcels. Supervisor Streich made a motion seconded by Supervisor Lehman supporting this minor land division and that the Dodge County Land Resources and Parks Department be informed of this action. All in favor motion carried. The date for Open Book will be June 24, 2008 from 3:00 - 6:00 p.m. and Board of Review will be on July 15, 2008 from 4:00 p.m. to 6:00 p.m. A complaint about the use of ATV vehicles and dirt bikes on property owned by Nicholas Reifsnider on Breezy Point Road was received. The Town of Fox Lake has a zoning ordinance and on May 14, 2007 at the request of M.R.S. Construction this property and the three parcels to the east were rezoned as residential. The use of ATV vehicles and dirt bikes on a parcel zoned residential is not a permitted use. Supervisor Babros made a motion seconded by Supervisor Wissing to inform Mr. Reifsnider that he is in violation of the zoning code and that he cease and desist in using ATV vehicles and dirt bikes on parcel number 018-1213-1214-003 in the Town of Fox Lake. All in favor motion carried. A communication from Municipal Judge Huettl concerning the possibility of legislative changes in the manner in which municipal courts are operated was reviewed. The Town Board will meet with Judge Huettl at 6:45 p.m. on May 12, 2008 to discuss this issue. The Town Board reviewed the list of road repair and maintenance projects developed after the road inspection and authorized Clerk-Treasurer Benter to prepare and publish bid specifications for the reconstruction of a portion of Blackhawk Trail, the surface course of hot mix asphalt for Spring Road from State Road 33 to Hickory Bay Road and also to prepare and publish bid specifications for seal coating, hot mix asphalt for paving/wedging, slurry seal, slag seal and gravel. Supervisor Wissing made motion seconded by Supervisor Babros to issue operators’ licenses to Heather J. Mijokovich, Timothy J. Zimmerman, Sara Harmsen, Keli Haffele, Deb Green, Andrew D. Mehan, Robert D. Haffele and Kara A. Blanc. All in favor motion carried. The Town Board considered a Conditional Use Permit Application submitted by Scott & Barb Quandt to allow filling and grading within 300 feet of a navigable body of water (Fox Lake) associated with the construction of retaining walls and steps on this site. This property is located in section 14 of the Town of Fox Lake. Supervisor Wissing made a motion seconded by Supervisor Babros to support this Conditional Use Permit and directed that the Dodge County Land Resources and Parks Department be informed of this decision. All in favor motion carried. Supervisor Babros made a motion seconded by Supervisor Wissing to pay bills subject to audit. All in favor motion carried.
