June 14, 2010 Monthly Board Meeting
Chairman Streich called the Town Board meeting to order with all officers present. Supervisor Babros made a motion seconded by Supervisor Lehman to move into closed session according to Wis. Stat. 19.85(1)(f) to consider specific personnel problems or the investigation of charges which, if discussed in public, would be likely to have a substantial adverse effect upon the reputation of persons involved in such problems or investigations. All in favor motion carried. Supervisor Alsteen made a motion seconded by Supervisor Babros to reconvene in open session. Chairman Streich reconvened the Town Board meeting with all officers present and 11 other citizens. Open Book to review assessments is Thursday, July 1, 2010 from 3:00 p.m. to 6:00 p.m. The next Town Board Meeting is Monday, July 12, 2010 at 7:30 p.m. Supervisor Lehman made a motion seconded by Supervisor Babros to accept the minutes of the Town Board Meeting of May 10, 2010. All in favor motion carried. The Treasurer’s report as of May 31, 2010 showed receipts for May, 2010 of $21,816.39, disbursements of $34,105.50 with a balance in the regular checking account of $155,999.29. The LGIPF account had interest receipts for May of $35.80 with a balance of $194,563.52. The Tax Savings Account had no activity with a balance of $167,132.32. The Municipal Court Savings Account had receipts in fines and assessments of $883.60 with a balance of $3,334.76. Supervisor Babros made a motion, seconded by Supervisor Alsteen to accept the Treasurer’s report. All in favor motion carried. Supervisor Flemming read a letter from Dawn Lewandoski thanking the Board for its efforts regarding the DNR parking lot on Sieske Road. Supervisor Alsteen questioned whether West Howard drive between Chief Kuno Trail and Howard Drive was actually a private road and was informed that it is a private road, he also felt the high water alarm off the aerator shed on Maple Pont should be abandoned thereby saving a monthly phone charge. This item will be on the agenda in July. Officer Mosher presented the Police & Lake Report for May, 2010. In May, 2010 the police officers worked 131.50 hours, responded to 3 complaints, assisted others 1 time, issued 3 warnings and 21 citations, assisted EMS once, responded to 1 accident and assisted 0 motorists. The lake patrol officers worked 40 hours, issued 3 warnings and 1 citation, and assisted EMS once. Supervisor Flemming reported that she attended the Fox Lake Correctional Institution community relations meeting. The new warden at FLCI, Larry Jenkins, will seek information regarding the proposed dairy farm and share what he is given with the Town and local citizens. Chairman Streich reviewed quotes from Scott Construction for road maintenance on Point Road, Box Road and Oaks Road. Supervisor Babros made a motion seconded by Supervisor Flemming to contract with Scott Construction to repair Point Road at a cost of $24,296.74, Box Road at a cost of $7,480.00 and Oakes Road at a cost of $14,982.42. All in favor motion carried. Supervisor Alsteen has had a floating aerator line off Maple Point marked with buoys and he gave an oral report comparing the 2008 electrical costs for aeration with the 2010 costs and stated that the 2010 costs were less. The public hearing for Liquor, Cigarette, and Operators License applications was called to order at 8:10 p.m. No comments or concerns were expressed regarding any of the applications. Supervisor Alsteen made a motion seconded by Supervisor Babros to issue Liquor Licenses to the eight businesses shown on the list attached to these minutes. All in favor motion carried. Supervisor Alsteen made a motion seconded by Supervisor Lehman to issue Cigarette Licenses to the three businesses shown on the list attached to these minutes. All in favor motion carried. Supervisor Babros made a motion seconded by Supervisor Flemming to issue Operators Licenses to the forty-one individuals shown on the list attached to these minutes. All in favor motion carried. Supervisor Alsteen made a motion seconded by Supervisor Babros to reject the application of Corrina N. Gray-Budziszek for an operator’s license. All in favor motion carried. Wade Oehmichen from the DNR presented a Memorandum of Agreement detailing the DNR and Town of Fox Lake responsibilities for the construction and maintenance of the three car parking lot to the east of Sieske Road. Supervisor Alsteen made a motion seconded by Supervisor Babros to agree to the stipulations of the Memorandum. All in favor motion carried. Supervisor Alsteen made a motion seconded by Supervisor Flemming to reimburse the City of Fox Lake $4,510 for work performed by Kunkel Engineering for the Fox Lake Dam failure analysis and the Trenton Street bridge inspection. All in favor motion carried. The concrete boat ramp/portage plan at the Dam proposed by Chairman Streich and tentatively accepted by City officials was reviewed. Supervisor Alsteen made a motion seconded by Supervisor Lehman that the Town should do what is required by NR 330 to provide safe and proper portage and signage. 4 in favor one opposed (Supervisor Flemming) motion carried. The 1998 Fox Lake & Lake Emily aeration system report from William Sweetman was reviewed. A consensus was reached to employ William Sweetman to repair the current broken line, remove broken helixors and provide updated information regarding the aeration systems. Chairman Streich announced that programmable thermostats would be installed in the Town Hall. Supervisor Alsteen made a motion, seconded by Supervisor Lehman to donate $500.00 to the Beaver Dam Lake Improvement Association to aid their projects on Beaver Dam Lake. All in favor motion carried. Supervisor Alsteen reported on information he had gathered regarding the change in floodplain elevations as determined by the DNR and FEMA. Floodplain maps were posted in the Town Hall showing which properties are now in the floodplain. He introduced David Anderson from Congressman Petri’s office and he concurred with Supervisor Alsteen that there is some question as to the determination and accuracy of the new elevation. Congressman Petri’s office will contact the DNR and FEMA and facilitate a public meeting involving these agencies to get information and determine if there is any recourse for property owners or the Town. Supervisor Alsteen presented information from the DNR about burn barrels and the burning of leaves and questioned whether the Town should consider an ordinance banning such activities. Supervisor Alsteen presented a plan for providing parking and a fishing area along the causeway on Chief Kuno Trail. He had received one quote for the gravel needed to fill the proposed areas and will seek additional quotes. Supervisor Babros made a motion seconded by Supervisor Lehman to appoint and authorize the Town Clerk-Treasurer to act as the Town representative on the Fox Lake Inland Lake District Board of Commissioners. Four in favor motion carried (Supervisor Alsteen failed to vote). The Town Board considered a request from Mavourneen Dowling at W10183 Hickory Bay Road to have deeded to her a parcel of land designated for the Hickory Bay roadway in 1957, a portion of which was already deeded back to the neighboring property in 1977. Supervisor Alsteen made a motion seconded by Supervisor Babros to issue a quit claim deed for $1.00 to Mavourneen Dowling for parcel number 018-1213-0244-013. All in favor motion carried. Supervisor Alsteen made a motion seconded by Supervisor Babros to pay bills subject to audit. All in favor motion carried. Supervisor Babros made a motion, seconded by Supervisor Lehman to adjourn.
