July 12, 2010 Monthly Board Meeting
Town of Fox Lake Monthly Board Meeting Monday, July 12, 2010 at 7:30 p.m. Chairman Streich called the Town Board meeting to order with all officers present and 16 other citizens. The Fox Lake Fire Association meeting is Tuesday, July 13, 2010 at 8:00 p.m. The Randolph Fire Association quarterly meeting is Wednesday, July 14, 2010 at 7:00 p.m. Board of Review is Thursday, July 22, 2010 at 4:00 p.m. The next Town Board Meeting is Monday, August 9, 2010 at 7:30 p.m. Supervisor Babros made a motion seconded by Supervisor Lehman to accept the minutes of the Town Board Meeting of June 14, 2010 with the correction of the spelling for Kunkel Engineering. All in favor motion carried. The Treasurer’s report as of June 30, 2010 showed receipts for June, 2010 of $21,412.60, disbursements of $71,416.96 with a balance in the regular checking account of $105,994.93. The LGIPF account had interest receipts for June of $35.52 with a balance of $194,599.04. The Tax Savings Account had interest receipts of $87.53 with a balance of $167,219.85. The Municipal Court Savings Account had interest receipts of $1.61 and receipts in fines and assessments of $2,137.20 with a balance of $5,473.57. Supervisor Alsteen made a motion, seconded by Supervisor Flemming to accept the Treasurer’s report. All in favor motion carried. Louis Leizinger expressed concerns about the speed of certain boaters on Fox Lake and also about the sealing job on Chief Kuno Trail. Ted Kahlow was concerned about trees along Howard Drive at the curve by the private road. Tanya Muench from WE energies introduced Mike Strader, project engineer for the Glacier Hills Wind Park, who explained the construction schedule for this project of 90 wind turbines and the transport of components for these turbines from the rail spur located just west of Spring Road on the south side of the Town of Fox Lake. Town Board members had received a proposed agreement regarding possible road damage resulting from the transport of these components and may also consider requiring a permit for the transport of each of the 90 tower sets. The agreement proposed or the permitting option will be considered at the August, 2010 meeting. Bob Bingen from Michaels Materials operator of the Alsum quarry on County Road F explained that they are the supplier of materials for the construction of access roads to the 90 wind turbine sites and requested an extension to the operation hours of the quarry so as to keep up with the demand for materials. Supervisor Alsteen made a motion seconded by Supervisor Babros to permit the quarry to operate between the hours of 8:00 p.m. and 6:00 a.m. as needed to produce more material for the Glacier Hills Wind Park project with the stipulation that no objections are received from the immediate neighbors in the Town of Fox Lake. All in favor motion carried. Dennis Buren explained his request for a Conditional Use Permit from Dodge County to allow filling and grading within 300 feet of a navigable body of water (Fox Lake) associated with the construction of retaining walls and a new house, the parcel number of this property is 018-1313-2723-017 and the part of this application to allow grading and excavating on the Ronald and Kathleen Paul property. Supervisor Alsteen made a motion seconded by Supervisor Lehman to support the issuance of a Conditional Use Permit to Dennis Buren and to inform the Dodge County Land Resources & Parks Department of such support. All in favor motion carried. David and Brian Hughes presented information regarding a proposed land division of the Carol Krueger property located at W11143 State Road 33, parcel number 018-1313-3321-000. The land division would create a separate parcel containing the buildings at this site. Supervisor Babros made a motion seconded by Supervisor Lehman to support the Carol Krueger land division into 2 parcels as presented by Grothman Land Surveyors and to inform the Dodge County Land Resources & Parks Department of such support. All in favor motion carried. Officer Gebhardt presented the Police & Lake Patrol Report for June, 2010. In June, 2010 the police officers worked 160.25 hours, responded to 7 complaints, assisted others 7 times, issued 9 warnings and 27 citations, and assisted 1 motorist. The lake patrol officers worked 8 hours and issued 1 citation. Supervisor Flemming reported on restrictions on the use of phosphorus and the effect on farmers and also reported that Fox Lake is considered impaired water by the DNR. Supervisor Babros and Chairman Streich reported that the Blackhawk Trail Storm Sewer project has been completed and that Struck & Irwin will repair some questionable slurry sealed areas on Chief Kuno Trail and Sunset Lane. Chairman Streich suggested that the Parks & Lakes Committee should get the pavilion pressure washed at the Fox Lake Town Park and at the same time considered pressure washing the Town Hall and spraying for spiders. The items identified by the DNR in their inspection of the Fox Lake Dam were reviewed. The signage and portage still needs to be completed. Supervisor Alsteen stated that Geno Huettner from the City would install the sign and make a gravel path. Supervisor Flemming distributed a petition regarding a ramp at the dam. Supervisor Alsteen asked that the ramp at the dam be placed on the August agenda. Chairman Streich will get the scour protection done. Permanent benchmarks still need to be installed at the dam site. No new information was received regarding the lines or helixors of the Fox Lake aeration system. Chairman Streich will contact William Sweetman to inspect, repair and/or remove a line and helixor. Supervisor Alsteen suggested holding a public information meeting regarding the new floodplain designations, however the Town Board indicated that with no one to make a presentation and with no new information to give the public such a meeting should be delayed until there is something to present. The estimated cost for materials and labor to provide parking and a fishing area along the causeway on Chief Kuno Trail is $2,784.00. Supervisor Flemming made a motion seconded by Supervisor Alsteen that the Town ordinances be revised first so that this project is in accord with such ordinances. All in favor motion carried. Supervisor Babros made a motion seconded by Supervisor Lehman to rescind the motion of June 14, 2010 to appoint and authorize the Town Clerk-Treasurer to act as the Town representative on the Fox Lake Inland Lake District Board of Commissioners. Four in favor, one opposed (Chairman Streich) motion carried. Chairman Streich appointed Supervisor Lehman as the Town representative to the Fox Lake Inland Lake District Board of Commissioners with no objection from the Town Board. Supervisor Alsteen inquired as to why he was not appointed and Chairman Streich replied that Supervisor Lehman has more Town Board experience. The bathroom doors and door closers at the Fox Lake and Lake Emily parks are being repaired by the Parks and Lakes Committee. Supervisor Alsteen stated that the DNR has told him that the high water alarm off of Maple Point is not necessary; however it was part of the approved plan for the construction of the new Fox Lake dam in 1999. Supervisor Alsteen will get written confirmation from the DNR that the high water alarm can be discontinued. Chairman Streich reported that the installation of new poles for the three phase electrical lines along Blackhawk Trail will begin soon and thanked Dale Paul for his willingness to permit the installation of poles on the wooded property at the east end, thereby eliminating lines crossing and re-crossing the road. Supervisor Alsteen would like to receive additional quotes for the relocation of the dog kennel at the Town Hall. This item will be on the August agenda. There are no delinquent 2009 personal property taxes owed to the Town. Supervisor Alsteen made a motion seconded by Supervisor Babros to issue operator licenses to Samantha Mevissen, Christine Hetrick and Linda Rank. All in favor motion carried. Supervisor Babros made a motion seconded by Supervisor Lehman to pay bills subject to audit. All in favor motion carried. Supervisor Lehman made a motion, seconded by Supervisor Babros to adjourn.
