August 9, 2010 Monthly Board Meeting

Town of Fox Lake Monthly Board Meeting
Monday, August 9, 2010 at 7:30 p.m.

Chairman Streich called the Town Board meeting to order with all
officers present and 12 other citizens. The Fox Lake Fire Association
meeting is Tuesday, August 10, 2010 at 8:00 p.m.  The next Town Board
Meeting is Monday, September 13, 2010 at 7:30 p.m.

Supervisor Babros made a motion seconded by Supervisor Lehman to
accept the minutes of the Town Board Meeting of July 12, 2010. All in
favor motion carried.

The Treasurer’s report as of July 31, 2010 showed receipts for July,
2010 of $40,298.26, a transfer from Municipal Court Savings of
$3,595.80, disbursements of $104,920.43 with a balance in the regular
checking account of $44,968.56.  The LGIPF account had interest
receipts for July of $35.99 with a balance of $194,635.03.  The Tax
Savings Account had no activity with a balance of $167,219.85.  The
Municipal Court Savings Account had a transfer to regular checking of
$3,595.80 and receipts in fines and assessments of $1,886.40 with a
balance of $3,764.17.  Supervisor Alsteen made a motion, seconded by
Supervisor Lehman to accept the Treasurer’s report.  All in favor
motion carried.

Supervisor Alsteen reported communications from three property owners
at the end of Chief Kuno Trail requesting no turn-around and no boat
access signs be placed at The Shores. He received complaints about the
spreading of manure in the field north of Fish N Fun and an inquiry
whether ATV travel for locals could be permitted on Chief Kuno Trail,
Blackhawk Trail and Howard Drive. 

Officer Gebhardt presented the Police & Lake Patrol Report for July,
2010. In July, 2010 the police officers worked 66.5 hours, responded
to 1 complaint, assisted others 1 time, and issued 1 warning and 4
citations. The lake patrol officers worked 27.5 hours, issued 1
warning, responded to 1 complaint and issued 2 citations.  Officer
Gebhardt also responded to the possibility of setting speed limits for
boats on Fox Lake and indicated it would be very difficult to enforce.
 This was supported by DNR Warden Nadolski who also stated that some
lakes have a slow-no-wake ordinance between sunset and sunrise for all
boaters.

Supervisor Flemming provided information regarding native mussels and
controlling phosphorus.

Supervisor Babros reported that some excavation for power poles and
ditching had been done on Blackhawk Trail Storm, the culvert on Brath
Road needs to be replaced before Scott Construction does road work,
some brush was cut on the curve on Howard Drive, and Chief Kuno Trail
was striped.

RC Painting will pressure wash the pavilion at the Fox Lake Town Park,
the restrooms at Fox Lake and Lake Emily boat landings and pressure
wash the Town Hall and spray for spiders.

The portage ramp at the Fox Lake dam will be excavated and graveled
and then a concrete ramp will be priced.

William Sweetman presented a report on the Fox Lake aeration system. 
Three of the four lines are in good condition with good air flow;
lines 1 and 2 have one operating helixor, lines 3 and 4 have no
helixors and line 3 is kinked and is missing 200 feet and another 150
feet is not attached.  He also stated that it appears that damage to
the system occurs because of anchors hooking lines and helixors.
Clerk-Treasurer Benter will try to contact Polcon Corp. the
manufacturer of the original helixors for possible replacements.
Supervisor Alsteen stated that the entire system should be replaced
with small bubble diffusers attached to the existing lines. 
Supervisor Lehman made a motion seconded by Supervisor Babros to
employ William Sweetman to repair the air lines and/or install new
tubing in the existing system.  3 in favor (Supervisor Alsteen and
Supervisor Flemming abstained) motion carried.  

Supervisor Alsteen reported on the public information meeting
regarding the new floodplain designations held on August 6, 2010. He
was critical of the DNR study to set the new floodplain levels and is
awaiting a report from Congressman Petri’s office.  Supervisor
Flemming added that there are two methods to get the floodplain map
amended; individuals may hire a surveyor and file a letter of map
amendment or; a government agency or local organization can hire a
certified engineer to document that the DNR/FEMA numbers are incorrect
and thereby get an entire area amended.

Supervisor Alsteen made a motion seconded by Supervisor Flemming to
amend ordinance Chapter 12 Public Works/Infrastructure by removing
Chief Kuno Trail as a causeway where fishing or swimming is not
permitted. Three in favor, 2 opposed (Supervisors Babros and Lehman)
motion carried.  Supervisor Flemming made a motion seconded by
Supervisor Alsteen to amend ordinance Chapter 13 Traffic that the “No
Parking” designation on Chief Kuno Trail be changed to read Chief Kuno
Trail except for spaces designated on north side of causeway.  Three
in favor, 2 opposed (Supervisors Babros and Lehman) motion carried.

Supervisor Alsteen made a motion seconded by Supervisor Lehman to
enter into an agreement with WE Energies to permit the transport of
materials and equipment exceeding allowable road weight limits to
Glacial Hills Wind Park with the provisions; that a $25.00 permit be
required for each over-weight vehicular trip using Inlet Road, Spring
Road, Trenton Street (County Road P) across the newly installed
culverts at the dam site, or Pleasant Road; that a bond be provided in
the amount of $500,000 for road resurfacing; and that the cost of the
repair of any sub grade damage of the roads named be assumed by WE
Energies.   All in favor, motion carried. 

Clerk Treasurer Benter will get written confirmation from the Rob
Davis of the DNR that the high water alarm can be discontinued.

Supervisor Alsteen made a motion seconded by Supervisor Babros that
rather than relocate the dog kennel at the Town Hall that a tarp be
purchased and used over the kennel for covering and shade.  All in
favor motion carried. 

The letter announcing the Special Garbage/Junk Pickup of September
7-11, 2010 will be mailed to Town residences.

Supervisor Babros made a motion seconded by Supervisor Lehman to
purchase (including installation) from Guard Dog Surveillance Systems
a Pan-Tilt-Zoom Camera at a cost of $2,180.72.  All in favor motion
carried.

The Dodge County Clean Sweep program is scheduled for September 18,
2010 at the Highway building on County Highway A.

Supervisor Alsteen made a motion seconded by Supervisor Lehman to
contract with General Asphalt to finish grade, compact and asphalt
pave the west side of the culvert area on the Chief Kuno Trail
causeway at a cost of $450.00.  All in favor motion carried.

Supervisor Babros made a motion seconded by Supervisor Lehman to pay
bills subject to audit.  All in favor motion carried.

Supervisor Lehman made a motion, seconded by Supervisor Babros to
adjourn.  All in favor motion carried.
